DMCA Policy for Ebola Virus
Ebola Virus respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
If you believe that any content on the Ebola Virus website infringes upon your copyright, please follow the procedures outlined below to submit a notification of claimed infringement.
Filing a DMCA Notice of Claimed Infringement
To file a DMCA notice of claimed infringement, you must provide us with a written communication that includes substantially the following:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL(s) of the material on the Ebola Virus site).
- Information reasonably sufficient to permit us to contact you, such as your address, telephone number, and email address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Upon receipt of a valid notice, Ebola Virus will investigate and take appropriate action, which may include removing or disabling access to the infringing material.
DMCA Counter-Notification Procedure
If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a counter-notification to us. To be effective, a counter-notification must be a written communication provided to our designated agent that includes substantially the following:
- An electronic or physical signature of the subscriber.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the URL(s) on the Ebola Virus site).
- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- The subscriber's name, address, and telephone number.
- A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which Ebola Virus may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. If that party does not file an action seeking a court order against the content provider, member, or user within 10 to 14 business days, we may restore the removed material or cease disabling access to it.
